Motoring Offences PDF Print E-mail

Motoring Offences

Where a driver accumulates 12 or more penalty points, then he or she become liable to disqualification under the "totting up" procedure.

The minimum periods of disqualification are:

6 months where no previous disqualification occurred within the preceding 3 years;

12 months where there is one such previous disqualification;

24 months where there are two such previous disqualifications;
If a driver can show that he or she would suffer "exceptional hardship" as a result of the loss of the driving licence, then the Magistrates may decide not to disqualify under totting up on that occasion.

However, where a motorist succeeds in showing that "exceptional hardship" would be caused (perhaps because they would, as a result, lose their employment), they will not be able to use the same argument again within the following 3 years.
