Employment 

Our work environment where we earn our living to pay our bills, can be fraught with difficulties. Most difficulties tend to be between Employer and Employee. Most people that come to us for advice are generally either in fear of losing or already have lost their job. Much of the protection for employees is Statute based and is designed to ensure that an employee is not unfairly dismissed or that if their employment has been terminated they are properly compensated for that loss.

If an employer dismisses an employee without just cause, then if that employee has been in continuous employment for a period of at least 12 months they may be entitled to compensation. (different rules may apply to part time employees).

The upper limit of the level of compensation payable has been greatly increased. We can often negotiate a settlement privately with the employer or if not by making an application to an Industrial Tribunal. There are strict time limits for making an application to a tribunal. Normally this is three months from the date of termination of employment. Whilst the application is being processed an organisation called ACAS may be able to mediate and reach a settlement with the employer as well avoiding a contested court hearing.
